Davis Names Judge Kathleen Butz From Nevada Superior Court to Fill Last Court of Appeal Vacancy

Gov. Gray Davis yesterday named Nevada Superior Court Judge M. Kathleen Butz to the Third District Court of Appeal.

If confirmed by the Commission on Judicial Appointments, Butz will fill the only remaining Court of Appeal vacancy. A confirmation hearing has been scheduled for Oct. 15 in Sacramento.

The commission consists of Chief Justice Ronald M. George, Attorney General Bill Lockyer, and the senior presiding justice of the Court of Appeal to which the appointment is made—in this case, Presiding Justice Arthur A. Scotland.

Butz, 53, a former presiding judge of the Nevada Superior Court, is presiding judge of its Family and Juvenile Court. She previously served on the court’s Appellate Department.

Before becoming a judge, she spent 14 years in private practice with the firms of Berliner & Spiller and Spiller, McProud, Butz and Kraemer in Nevada City. She handled real property litigation, land use and planning, personal injury and wrongful death cases, and complex business litigation.

She earned her undergraduate and law degrees from the UC Davis. If confirmed, she will replace Justice Consuelo Callahan, who now serves on the Ninth U.S. Circuit Court of Appeals.

Requests to testify before the commission on Oct. 15 must be received by Oct. 8.
