Court of Appeal to Hold ‘Public Meeting’

The Court of Appeal for this district has posted a public meeting agenda containing a single item unlikely to evoke controversy: whether a research attorney is to be kept on the job for a spell after retirement.
On the agenda for Oct. 14 at 11 a.m. is a “[r]esolution to approve the appointment of Jeffrey Blackie as a retired annuitant to fill a critically needed Senior Appellate Court Attorney position within the 180-day period after retirement, as authorized by Government Code sections 7522.56(f)(1) and 21224(a).”
Government Code §(f) provides:
“A retired person shall not be eligible to be employed pursuant to this section for a period of 180 days following the date of retirement unless the retired person meets one of the following conditions: [¶] (1) The employer certifies the nature of the employment and that the appointment is necessary to fill a critically needed position before 180 days have passed and the appointment has been approved by the governing body of the employer in a public meeting. The appointment may not be placed on a consent calendar.”
Written comments are due on Thursday at 4 p.m.
Court Clerk/Executive Officer Eva McClintock said Friday that Justice Victoria M. Chavez of Div. Two will preside over the meeting with no other justice participating.
She related that Blackie “worked in Division One before retiring in July 2025,” noting:
“He had 22 years of court experience at the time of his retirement.”
McClintock said the last such meeting was held Feb. 25.
Admitted to practice in 1990, Blackie is a graduate of the University of California Hastings College of Law.
