Commission to Consider Appointment of Scherb to Court of Appeal

The Commission on Judicial Appointments will hold an in-person public hearing in San Francisco at 9 a.m. on Monday to consider the nomination of California Supreme Court chambers attorney Matthew Scherb to the role of an associate justice of Div. Eight of this district’s Court of Appeal.
If confirmed, Scherb will fill the vacancy created by the retirement of Justice Elizabeth Grimes. He has served in his current post since 2021 and previously worked as a Los Angeles deputy city attorney, from 2017-21, as well as a research lawyer for the First District Court of Appeal, between 2011-17.
A graduate of Northwestern University Pritzker School of Law, he clerked for the U.S. District Court for the District of Columbia for one year, starting in 2004, and worked as an associate with Winston & Strawn LLP from 2005-11.
Chief Justice Patricia Guerrero, Attorney General Rob Bonta, and Senior Court of Appeal Presiding Justice Arthur Gilbert of this district’s Div. Six, who will appear virtually, will consider Scherb’s nomination.

On Monday, the commission will also consider the nomination of San Bernardino Superior Court Judge Corey Lee to serve as a justice on Div. Two of the Fourth District Court of Appeal and the appointment of Fresno Superior Court Judge Arlan L. Harrell to the Fifth District Court of Appeal.
