Hearing Set on Writ Petitions Of Hammond, Huerta

Los Angeles Superior Court Judge James Chalfant yesterday set a Thursday hearing date on writ petitions filed by rival candidates for Los Angeles Superior Court Office No. 118.

Melissa Hammond, a deputy district attorney, is asking that retired prosecutor Gloria Huerta be barred from using the ballot designation of “Deputy District Attorney” because she no longer holds that post and does have a current profession as an “attorney,” being an active member of the State Bar.

Huerta, in turn, wants the registrar recorder to be ordered to use her preferred ballot designation, “Deputy District Attorney, County of Los Angeles,” which is used by two current prosecutors in the race: Hammond and Keith Koyano.

Opposition briefs, limited to five pages, are due today and no reply papers were ordered. Chalfant said he would rule by Friday, if not on the date of the hearing.

Meanwhile, Los Angeles District Court Judge Mitchell Beckloff has scheduled a Thursday hearing date on a petition for a writ of mandate aimed at blocking inclusion of the name of former assistant U.S. attorney Marina Torres on the June 7 ballot as a candidate for Los Angeles city attorney. The petition, brought in the name of voter Judy Hu and apparently instigated by the campaign committee for candidate Richard Kim, a deputy city attorney, contends that Torres does not meet the qualifications for office set forth in the city charter.
