C.A. Orders Publication of Opinion Withholding Teacher’s Name

Div. Two of the Fourth District Court of Appeal has ordered publication of a redacted version of an opinion holding that two documents from a probe into allegations that a former high school girls’ volleyball coach bullied players are not subject to release under the Public Records Act, with the coach’s identity being concealed notwithstanding newspaper accounts in San Bernardino identifying him.

Acting Presiding Justice Art W. McKinster wrote the opinion, filed Nov. 29 and was certified for publication on Thursday. It holds that the ex-coach’s privacy interests outweigh the public’s interest in disclosure of the documents.

The subject of the investigation by the Chino Valley Unified School District was Bernie Wendling, who still teaches math at Ayala High School.

The case is Associated Chino Teachers v. Chino Valley Unified School District, E068163.

In ordering publication, the court noted that it was granting a request of the appellant, Associated Chino Teachers, as well as that of the American Federation of State, County and Municipal Employees, the California Faculty Association, the California Federation of Teachers, the California School Employees Association, and the Service Employees International Union.
