Ninth Circuit Affirms $10.1 Million Attorney Fee Award

The Ninth U.S. Circuit Court of Appeals has upheld a District Court decision affirming a decision of the Bankruptcy Court to award $10.1 million in attorney fees to Barrett Litt of the Pasadena law firm of Kaye, McLane, Bednarski & Litt.

Tuesday’s unpublished decision ion McClure v. Litt says the fee award stems from Litt’s representation of Shirley Ann McClure in an action against the City of Long Beach which allegedly harassed her and took retaliatory measures against her in operating facilities to treat patients with Alzheimer disease, forcing her into bankruptcy.

Litt obtained a $20 million settlement.

The court said Litt’s efforts on McClure’s behalf extended over a decade and there was no abuse of discretion in setting the fee.
