Confirmation Hearings Slated for Nominees for Div. Eight of Court of Appeal

By a MetNews Staff Writer

Confirmation hearings have been scheduled for Nov. 21 to consider Gov. Gray Davis’ nominations of three local jurists to serve on the newly created Div. Eight of this district’s Court of Appeal, officials said yesterday.

Davis Wednesday nominated Justice Candace Cooper of Div. Two to be presiding justice of Div. Eight, and Los Angeles Superior Court Judges Paul Boland and Laurence D. Rubin to be associate justices in that division.

The division is authorized four positions, so one vacancy remains to be filled by the governor, but court officials said the panel will be up and running next month if the three nominees are confirmed as expected.

The hearings are to be held in the courtroom of the Ronald Reagan Building in downtown Los Angeles. The hearing for Boland is to begin at 10 a.m., followed immediately by the hearings for Rubin and Cooper.

The nominations will be considered by the Commission on Judicial Appointments. When considering Second District Court of Appeal nominations, the commission consists of Chief Justice Ronald M. George, Attorney General Bill Lockyer, and the district’s senior presiding justice, Joan Dempsey Klein of this district’s Div. Three.

The deadline for written comment on any of the nominations, or to notify the commission that one wishes to speak at the hearing, is Nov. 14 at 5 p.m.

The commission requested  that communications be addressed to the chief justice at 350 McAllister Street, San Francisco, CA 94102, Attention:  Ms. Gale Tunnell, Secretary to the Commission on Judicial Appointments.

Requests to speak must include a summary of the facts on which any testimony or opinion will be based, under the commission’s guidelines.
