A confirmation hearing has been scheduled for Feb. 8 to consider Gov. Gray Davis’ nomination of Orange Superior Court Judge Richard Fybel to Div. Three of the Fourth District Court of Appeal, officials said yesterday.

The hearing is to be held at 10 a.m. in the courtroom of the Ronald Reagan Building in downtown Los Angeles.

The nomination will be considered by the Commission on Judicial Appointments. When considering Fourth District Court of Appeal nominations, the commission consists of Chief Justice Ronald M. George, Attorney General Bill Lockyer, and the district’s senior presiding justice, Daniel Kremer.

The deadline for written comment on any of the nominations, or to notify the commission that one wishes to speak at the hearing, is Feb. 1 at 5 p.m.

The commission requested that communications be addressed to the chief justice at 350 McAllister Street, San Francisco, CA 94102, Attention:  Ms. Gale Tunnell, Secretary to the Commission on Judicial Appointments.

Requests to speak must include a summary of the facts on which any testimony or opinion will be based, under the commission’s guidelines.
